Terms and Conditions

IMPORTANT: Kunote is a free service provided as-is. By using it you accept all risks associated with storing your data on a free, independently operated platform. Do not use Kunote as your only copy of important information.

1. Agreement

By creating an account or using Kunote ("the Service") at kunote.app, you agree to these Terms and Conditions ("Terms"). If you do not agree, please do not use the Service.

The Service is operated by Andras Sebo ("we", "us", "our"). You can reach us at info@kunote.app.

2. The Service

Kunote is a free, cloud-based note-taking application that lets you capture and organise text notes, photos, and sketches. Your content is stored securely in Supabase infrastructure located in the European Union. The Service is provided at no charge and is operated by an individual on a best-effort basis, without commercial guarantees of any kind.

3. Eligibility

You must be at least 16 years old to use the Service. By using Kunote you confirm that you meet this age requirement. You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others. You must not upload content that is illegal, harmful, defamatory, obscene, or that infringes third-party intellectual property rights. You must not attempt to gain unauthorised access to the Service, other users' accounts, or our infrastructure. You must not use the Service to distribute malware, conduct automated attacks, or scrape data in ways not permitted by these Terms. We reserve the right to suspend or terminate accounts that violate these rules, without prior notice where necessary.

5. Your Content

You retain full ownership of all notes, photos, and sketches you create. By uploading content to Kunote, you grant us a limited, non-exclusive, royalty-free licence to store and serve that content solely for the purpose of providing the Service to you. We do not claim ownership of your content and we do not use it for any purpose other than operating the Service.

6. Account Deletion

You may delete your account at any time from within the app. Upon deletion, all your data — notes, photos, sketches, tags, and account information — is permanently and immediately deleted. This action is irreversible. We cannot restore deleted accounts or any content associated with them.

7. Third-Party Services

The Service relies on third-party infrastructure providers including Supabase (database and file storage), Vercel (hosting and deployment), and Cloudflare (domain and network layer). Your use of the Service is subject to the terms and availability of these providers. We are not responsible for any service interruptions, data loss, or other issues caused by these providers. We have no control over their systems, their uptime, or changes to their platforms. Authentication through Google and GitHub is similarly governed by those providers' own terms and privacy policies.

8. Service Availability and Data Loss

We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.

We do not guarantee the integrity or continued availability of any data stored in the Service. Data loss may occur due to software bugs, hardware failure, third-party provider outages, network issues, human error, or other causes beyond our control. You are solely responsible for maintaining independent backups of any content you consider important. We strongly recommend you do not rely on Kunote as your only copy of critical information.

9. Limitation of Liability and Use at Your Own Risk

The Service is provided free of charge and you use it entirely at your own risk.

To the fullest extent permitted by applicable law, Andras Sebo shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to: loss of data or content (notes, photos, sketches), loss of access to your account, service downtime, data corruption, or any other harm arising out of or related to your use of or inability to use the Service — regardless of whether the cause is a software bug, a security incident, a failure or change in a third-party service (including Supabase, Vercel, or Cloudflare), or any other reason.

We are not responsible for and have no control over the actions, omissions, availability, or data handling practices of Supabase, Vercel, Cloudflare, Google, or GitHub. Any issues arising from those services are governed solely by their own terms.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under applicable consumer protection law.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page. Material changes will be communicated through the app. Continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.

11. Governing Law

These Terms are governed by the laws of Hungary and, where applicable, the laws of the European Union. Any disputes arising under these Terms shall be subject to the jurisdiction of the competent courts in Hungary, without prejudice to your rights as a consumer under applicable EU law.
